Bemister case back in court for pre-sentencing

A Grand Falls-Windsor man was in provincial court in Gander April 14 for a pre-sentencing report on a number of charges stemming from incidents at two Gander bars Sept. 29.

BACK IN COURT – Patrick Wallace Bemister, 27, was in provincial court in Gander on April 14 for a pre-sentencing report. Bemister is to be sentenced on May 15 for three charges of assault and a breach of probation stemming from incidents that occurred at two Gander bars on Sept. 29.


Judge Jacqueline Jenkins presided over the report, as Crown prosecutor Gina Walsh requested Patrick Wallace Bemister, 27, be sentenced to 4-6 months in jail, along with a number of conditions. Defence lawyer Amanda Hiscock asked for a 90-day sentence that would be served intermittently.

Bemister pleaded guilty Feb. 25 to three charges of assault, as well as a breach of probation. Two charges of uttering threats to cause death were withdrawn, along with a charge of assault with a weapon. A breach of probation charge was also withdrawn.

When given a chance to address the court, Bemister expressed apologies.

“I’d like to apologize to the victims,” he said. “I feel I’m on a positive road to rehabilitation. I’m trying to change the best I can to be a role model for my kids.”

Bemister was arrested Oct. 7 after he turned himself in to RCMP in Grand Falls-Windsor. A Canadian-wide warrant was issued for his arrest Oct. 4.

On Oct. 11, Bemister was released on a $5,000 bail order, along with a number of conditions that are still required until sentencing.

The conditions include being prohibited from having any association with anyone affiliated with the Outlaws Motorcycle Club, wearing the colours, patch or any identifiers of the Outlaws Motorcycle Club, or attending anyplace where the Outlaws Motorcycle Club members are known to associate.

He is also prohibited from concealing any knife, and being in possession of or in any dwelling where there is storage of any firearm, crossbow, prohibited weapon, restricted weapon, prohibited device, ammunition, prohibited ammunition or explosive device.

“I will give consideration to reports submitted by counsel,” Jenkins said.

Bemister will be back in court May 15 to be sentenced on the three charges of assault, along with the breach of probation charge.
