Ex-Nomad walks free after wearing colours twice at Gold Coast venues

A FORMER bikie blew kisses outside court yesterday after escaping further penalty for wearing gang colours on two occasions in Surfers Paradise.

Matthew William Archer spent up to five hours in lockup twice in September last year after police caught him wearing his club colours in licensed venues – an offence under laws since repealed by the State Government.

On one occasion, Archer wore a Nomads bikies shirt to dinner after the restaurateur told him he would not be seen at a quiet table at the back.

Magistrate Bernadette Callaghan yesterday said jail time was not an option for the crime and she could only impose a fine.

Ms Callaghan said she would take the two separate stints of four to five hours in custody as time served and convicted Archer with no further punishment.

“It’s the equivalent of quite a hefty fine,” she said.

“These crimes are only punishable by a fine.”

The Southport Magistrates Court was told yesterday that police were tapping Archer’s phone and undercover officers soon made conversation with the patched bikie, asking him for drugs, only to be denied.

Soon after, police returned to arrest him for wearing his colours in a licensed venue.

On another occasion, Archer spent the night at the Hilton Hotel in Surfers Paradise with his friend and fellow patched bikie Sven Christian Kelly.

Both were arrested and locked up by police for wearing Nomads hoodies in the lobby of the building.

Moloney MacCallum Lawyers director Campbell MacCallum said Archer had disassociated himself from the Nomads bikie gang and provided an affidavit to the court to prove his client had turned in his colours.

“Mr Archer has openly distanced himself from Outlaw Motorcycle Gangs,” he said.

Sven Kelly was also convicted and not further punished.
